Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and PulseBox ("PulseBox", "we", "us"). They govern your access to and use of the PulseBox website, web game, mobile applications and any related services (together, the "Service"). Please read them carefully, by using the Service you accept them in full.
1. Acceptance of these Terms
By loading, browsing, downloading, installing or playing PulseBox you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must stop using the Service.
If you are using PulseBox on behalf of an organisation, for example in a classroom, clinic or workplace training setting, you confirm that you have authority to bind that organisation and "you" refers to both you and that organisation.
2. Eligibility and age
The Service is intended for a general audience. You may use PulseBox if you are at least 13 years old or the minimum digital-consent age in your country if that age is higher (for example 16 in parts of the European Economic Area). If you are below the age of majority where you live, you may only use PulseBox with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
We do not knowingly permit accounts or data collection from children below these ages. If we learn that we have collected information from a child in breach of applicable law, we will delete it.
3. The Service and its availability
PulseBox is a minimalist rhythm and memory training game: a pattern is shown, you reproduce it and difficulty scales with your accuracy. The Service is provided on an "as available" basis.
- We may add, change, throttle, suspend or remove modes, levels, mechanics, scoring rules or features at any time.
- We may perform maintenance, deploy updates or take the Service offline without prior notice, though we will try to give notice for planned downtime.
- Certain features depend on your device, browser, operating system version and internet connection. We do not guarantee compatibility with every configuration.
We do not promise uninterrupted or error-free operation. If continuous availability matters to you, do not rely on PulseBox as a critical tool.
4. Accounts, devices and progress
PulseBox is designed to be played without a signup. Where no account exists, your progress, scores, streaks, unlocked modes and preferences, is stored locally on your device.
4.1 Loss of local progress
Clearing your browser storage, using private or incognito browsing, switching devices or browsers, reinstalling the app or having storage evicted by your operating system will erase local progress. We cannot recover it.
4.2 Optional accounts
If we later offer optional accounts, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised access.
5. Fair play and prohibited conduct
PulseBox is a skill game. Progression is meant to reflect real performance. You agree not to:
- use bots, scripts, macros, auto-clickers, emulated input or any automation to play or to generate results;
- modify, decompile, disassemble, reverse engineer or create derivative works of the Service, except where such restriction is prohibited by law;
- tamper with client code, network traffic, memory, local storage or timing in order to alter scores, lives, ranks or unlocks;
- exploit bugs, glitches or unintended mechanics instead of reporting them to us;
- scrape, crawl, mass-download or index the Service beyond ordinary personal use;
- probe, scan, stress-test, overload or attempt to gain unauthorised access to the Service or its infrastructure;
- resell, sublicense, rent, commercially exploit or present the Service as your own;
- use the Service unlawfully or to harass, defraud, impersonate or harm any person.
We may invalidate scores, reset progression or restrict access where we reasonably believe these rules have been breached.
6. Progression, ranks and leaderboards
Modes, tiers and cosmetic unlocks are earned through play and cannot be bought. Any leaderboard, ranking or statistic is provided for entertainment only, may be recalculated, corrected or reset and confers no ownership, monetary value or entitlement. We may remove entries we consider fraudulent, automated or abusive.
7. Price, purchases and virtual items
PulseBox is currently free to play with no signup and no compulsory purchases. If we introduce optional paid items or subscriptions in future, they will be clearly described at the point of purchase, processed by the relevant app store or payment provider and subject to that provider's billing, refund and cancellation rules as well as your statutory rights. Virtual items are a limited, personal, non-transferable, revocable licence, not property and not redeemable for cash.
8. Content you submit
When you send us feedback, bug reports, suggestions or messages through our contact form, you grant us a worldwide, royalty-free, perpetual licence to use, reproduce and incorporate that material into the Service without obligation, attribution or compensation. Do not send us anything confidential, unlawful, infringing or that you are not entitled to share.
9. Intellectual property
The Service and everything in it, the PulseBox name and logo, pixel wordmark, interface design, colour system, artwork, animations, audio, level structures, copy, code and underlying know-how, is owned by PulseBox or its licensors and protected by copyright, trade mark and other laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and play the Service for your own non-commercial enjoyment. All rights not expressly granted are reserved. You may capture and share gameplay footage or screenshots for non-commercial purposes provided you do not imply endorsement or remove our branding.
10. Third-party services and stores
The Service may be distributed through the Apple App Store or Google Play and may rely on third-party hosting, font, analytics or infrastructure providers. Their terms apply to their part of the experience and we are not responsible for third-party content, availability or practices. Where a platform's rules conflict with these Terms for a store-distributed copy, that platform's rules prevail for that copy.
11. Suspension and termination
You may stop using PulseBox at any time by closing it, deleting the app or clearing its stored data. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we suspect fraud or automated play, if required by law or if we discontinue the Service. Sections that by their nature should survive termination, including intellectual property, disclaimers, liability limits, indemnity and governing law, continue to apply.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted availability or freedom from harmful components.
PulseBox is entertainment. It is not a medical device or diagnostic tool and we make no claim that it treats, prevents, diagnoses or improves any medical or cognitive condition. Nothing here excludes rights you have as a consumer that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, PulseBox and its team will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for lost profits, lost data, lost progress, device damage or business interruption, arising out of or relating to the Service, however caused and on any theory of liability.
Our aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim or USD 50. Nothing limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot lawfully be limited.
14. Indemnity
You agree to indemnify and hold harmless PulseBox, its team and its licensors from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms or your violation of any law or third-party right.
15. Health and safe play
Fast visual sequences can be uncomfortable for some players. If you experience dizziness, eye strain, headaches, altered vision, muscle twitching, disorientation or any seizure-like symptom, stop playing immediately and seek medical advice. Play in a well-lit room, take a break at least every 30 minutes and do not play while driving, operating machinery or in any situation requiring your attention. If you have a photosensitive condition, consult a doctor before playing and enable your system's reduced-motion setting, which PulseBox respects.
16. Changes to the Service and Terms
We may revise these Terms to reflect changes in the Service, our practices or the law. When we do, we will update the version number and "last updated" date at the top of this page and for material changes we will provide a reasonable in-app or on-site notice before they take effect. Continuing to use the Service after changes take effect means you accept the revised Terms. If you do not accept them, stop using the Service.
17. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your country of residence.
Before starting formal proceedings, please contact us so we can try to resolve the matter informally within 30 days.
18. General provisions
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between us regarding the Service.
- Severability: if any provision is unenforceable, the rest remains in force.
- No waiver: not enforcing a provision is not a waiver of it.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure: we are not liable for failures caused by events beyond our reasonable control.
- Language: the English version of these Terms prevails over any translation.
